Special Visa for Employment Generation – timely.

26 11 2008

AlinsugLaw, Philippines. — PGMA signed Executive Order No. 758 or the Special Visa for Employment Generation (SVEG). Under this EO a special non-immigrant visa which entitles holders multiple entry privileges if the foreigner employs at least 10 employees. Section 1 of the EO explains the purpose of the SVEG, as follows:

“The SVEG is a special visa issued to a qualified non-immigrant foreigner who shall actually employ at least ten (10) Filipinos in a lawful and sustainable enterprise, trade or industry. Qualified foreigners who are granted the SVEG shall be considered special non-immigrants with multiply entry privileges and conditional extended stay, without need of prior departure from the Philippines.
The privileges of this Executive Order may extend to the qualified foreigner’s spouse and dependent unmarried child/children below eighteen ( 18 ) years of age whether legitimate, illegitimate or adopted.”

Click here for the complete copy of the EO 758.

While this is timely under the current national and international financial situation, it remains to be seen if sufficient safety nets will be provided to effectively weed out unwanted foreigners (fugitives, criminals, terrorists etc.).

November 2008 Visa Bulletin – EB3 Priority Date is May 1, 2005

19 10 2008

AlinsugLaw, October 20, 2008.  In the recently released November 2008 Visa Bulletin, the priority date for the employment-based visa category 3 (or EB3) moved to May 1, 2005.  This is a bit of good news for nurses whose priority dates have become current.  On another note, it seems unlikely that a new law to address the retrogression issue on a more or less permanent basis will be passed within the year.

Unavailable to January 1, 2005 – October 2008 Visa Bulletin

12 09 2008

AlinsugLaw September 12, 2008 — The US Department of State had just issued the Visa Bulletin for October 2008. As regards Filipino nurses waiting on any development on visa availability, the October 2008 Visa Bulletin, at least, brings some movement. Since last July the employment-based visa category (EB3) under which nurses generally fall, has been UNAVAILABLE. In the current Visa Bulletin, the priority date has moved to January 1, 2005 (the same as that in the March 2008 Visa Bulletin). This is a welcome development considering that come October 2008, the new immigration calendar will begin which means that new visas will become available. Below is the relevant portion of the current Visa Bulletin: Read the rest of this entry »
